The concierge «La Bretonne» is a company of short and medium term seasonal real estate rental operating in the municipalities of Landéda, Lannilis, Plouguerneau, and offering services and advice mainly to individuals.
It is addressed in particular to the owners who mandate for the management of their seasonal rental and to their tenants to facilitate their stay.
As part of the real estate management for which it is mandated, the concierge «La Bretonne» offers the owners' accommodation to seasonal rentals via the address: https:// la-bretonne.fr(hereinafter the website) and also online booking platforms.
The concierge offers various services to owners and tenants of residences.
The characteristics of these services are available on the concierge’s website (accessible at the following address: https://la-bretonne.fr.
This information is provided for information purposes and may be revised at any time.
The performance of services is provided by the concierge «La Bretonne» itself if the request does not require specific and/ or regulated qualifications.
The concierge «La Bretonne» can also act as an agent by calling on professional or private third parties depending on the case.
- . DEFINITIONS
The terms used in this document shall have the following meaning for the interpretation of the general conditions of sale and without distinction:

The company is represented by Céline LEBRETON in her capacity as manager, who holds the professional card and is therefore listed on the Real Estate Professionals' Register in accordance with the obligations set out in Law n°70-9 of 2 January 1970, known as the "Hoguet" Act.
v “The owner”: a person who owns an accommodation and who commissions the concierge to manage the rental of his second home.
As part of the management mandate, the owner authorizes the concierge to delegate the execution of one or more services to a professional or private third party (hereinafter referred to as “the service provider”).
v " the client/ the vacationer/ the tenant/ the traveller " : any natural person over 18 years of age, or legal entity having booked and paid for a stay and services at the concierge «La Bretonne».
v " Third-party service provider " means any legal or natural person performing, at the request of the owner, works, services or sales of products through the intermediary of the concierge La Bretonne.
v " The order " means any order from the customer relating to services offered by the concierge La Bretonne and accepted by the latter under the conditions defined herein.

v «Services»: the services offered by the concierge La Bretonne to guests and owners of accommodation
- SCOPE OF APPLICATION OF THESE CONDITIONS
These General Conditions of Sale apply without restriction or reservation to any purchase of concierge services offered by the concierge «La Bretonne» on its website https://la-bretonne.fr. This link is also present on each quotation/ contract sent to the customer. Thus, the customer does not commit any restriction and reservation to these General Conditions of Sale.
In accordance with the legal provisions provided for by article L.111-1 of the consumer code, a confirmation email confirming the receipt of the signed mandate will be sent to the owner after the conclusion of the latter, accompanied by the GTC in PDF format.
The customer declares to have read and accept the GTC before placing any order for services and accepts without reservation these GTC.
- . THE SERVICES OFFERED
The concierge «La Bretonne» offers owners of apartments or houses to manage seasonal rentals as part of a seasonal rental management mandate.
This mandate for seasonal rental management is in the form of a written contract between the concierge service "La Bretonne" and the owner of the residence who entrusts to the concierge service the responsibility of performing all administrative acts necessary for the proper management of the accommodation, a commission on all rents collected.
The concierge «La Bretonne» offers access to its concierge services and management of seasonal rentals in the form of integral management or «à la carte» services that will be subject to a free quote.

- Creation of a personalized welcome booklet for vacationers that relates the rules of operation of housing, recommendations, emergency numbers, amenities...
- Drawing up an inventory
- Creation and distribution of the ads on the concierge’s website and on booking platforms
- Management of availability calendar and booking schedule
- Maintenance and vigilance of residences throughout the year
- Follow-up of small renovation or decoration works
- Maintenance of the garden, swimming pool and outdoor...
- Management of orders (fuel, wood...);
- Large spring cleaning

- Sending and tracking of contracts (signature, deposit, balance)

- Reception of travellers, taking inventory of the entry premises, inventory.

- Assistance during the stay of travelers in case of emergency (breakdown, leak, breakage,...). Intervention by the concierge, or contact with a professional
- Collection of keys at the end of the stay, inventory of the departure, payment of the amounts due on departure.

La Conciergerie «La Bretonne» is committed to doing everything possible to respond to the requests of its clients as soon as possible.
Customers wishing to book a stay can do so directly on the property announcement posted on the booking platforms or also on the concierge site.
In this case, the client must contact La conciergerie «La Bretonne» to confirm availability and the rate applicable to the desired dates of booking.
It should be noted that all subscriptions to the services of the concierge «La Bretonne» are strictly personal. The benefit of an order placed with the concierge La Bretonne is reserved for customers (owners and vacationers) and may not be transferred to a third party without prior express agreement of the concierge «La Bretonne».
- Conditions applicable to all orders
Any order will become final only after being confirmed in writing by the concierge «la Bretonne» by electronic means or by post. Any request for modification or cancellation by the Customer of an order confirmed by the concierge «La Bretonne», must occur at least thirty (30) calendar days before the start of the Services to be taken into account by the concierge. It being specified that any request for modification remains subject to the assessment and acceptance of the concierge. Any request for modification or cancellation by the Client after the time limit defined in paragraph «E» may be rejected by the concierge. In such case, the price of the order will remain due by the Customer and the sums already paid by the Customer will not be returned in any case.
- Pricing and order validation
The price of the proposed rentals and additional services will be charged on the basis of the rates defined in the tariff proposal established by the concierge for the client.
The rates of the proposed rentals are indicated on the booking site and vary according to the rental period.
The concierge «La Bretonne» reserves the right to change its prices at any time. All stays are billed on the basis of current rates announced online at time of booking.
Prices are inclusive of taxes and are expressed in Euros. They are defined as accommodation and overnight stays, unless otherwise stated.
Any travel costs will be charged in accordance with the tariff proposal. For services billed by the concierge, any half-hour started will be due in full.
In addition to the rent of the rental, additional services are charged to the customer:
The cleaning service at the end of the stay, defined according to the type and surface of the accommodation, is mandatory and will be systematically charged to the client in addition to the rent.
The client may subscribe, on request, and optionally, a package of linen supply, charged according to the number of beds in the rented accommodation.
The tourist tax is added to these services. It is defined by the municipality of location according to the rate applicable to each category of accommodation multiplied by the number of nights recorded, then by the number of taxable persons. The concierge «La Bretonne» is responsible for collecting the tax from the Client in order to pay it to whom they are entitled to.
The customer can order his stay and the services connected to it directly on the booking platform. The confirmation of the reservation will not be effective as soon as the concierge has the confirmation of payment of the deposit made by the customer.
The client also has the possibility to book by contacting the concierge «La Bretonne» directly by phone or email. In this case, a quote corresponding to the customer’s request will be communicated to him as soon as possible. The client is free to accept or reject the proposal.
Any order will become final only after receipt of the quote dated, signed and sent by the customer to the concierge by electronic means (at: conciergerie@la-bretonne.fr) or by post, and by confirmation of the payment of the deposit requested.
In the event that the Services could not be performed under the conditions envisaged at the time of the realization of the tariff proposal by the concierge, the latter undertakes to use all reasonable means to formulate an alternative proposal to the client. The alternative proposals will only be implemented after written agreement of the client.
The concierge «La Bretonne» reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of an earlier order.
- Settlement of the stay: The deposit and balance
A deposit corresponding to 25% of the total price of the stay (rental of accommodation + services) is required when placing the order by the customer. This deposit can not be qualified as a deposit.
In the case where the booking was made on a booking platform, the deposit is paid directly via this booking platform.
In the case where the reservation was made on validation of the quote sent by the concierge, the deposit of 25% of the total amount of the stay (rental of accommodation + services) must be made by bank transfer or CB payment to the order of the concierge La Bretonne within 48 hours following the validation of the order form.
The balance of the stay will be due 30 days before the arrival date.
In the event that the reservation of accommodation occurs less than 30 days before taking possession of the premises, the full price of the stay (rental of accommodation + services) will be required at the time of booking.
- Termination of contract and refunds
- At the initiative of the concierge
Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the customer will cause the cancellation of the order at the expense of the customer, without prejudice to any civil or criminal action against the concierge.
- At the initiative of the customer
The cancellation at the request of the customer will only occur after receipt of a written notification from the customer by electronic or postal means.
The reimbursement of the stay will be made in accordance with the following modalities:
- Full refund for cancellations made up to 60 days before arrival
- Refund of 50% for cancellations made between 60 and 30 days before arrival
- No refund for cancellations made within 30 days prior to arrival
6 - ASSURANCES OF THE PARTIES
- La Bretonneis a professional multi-risk insurance policy for the performance of its activity.
- The owner of the accommodation expressly guarantees that he has taken out a multi-hazard home insurance on his property as well as an insurance for seasonal rentals.
- The tenant is required to be sufficiently against rental risks (theft, fire, water damage, broken glass...). He undertakes to verify that his main housing contract provides for the extension of the resort (holiday rentals).
Any flight within the rental period will be charged to the renter.
7 - OBLIGATIONS AND LIABILITIES
- Obligations and responsibilities of the concierge
The concierge implements all measures to ensure quality services, in optimal conditions, within the framework of its obligation of means.
It cannot, however, under any circumstances be held liable for any non-performance or improper performance of all or part of the services provided for in the contract which would be attributable either to the customer or to the service provider or supplier, either to the unforeseeable and insurmountable fact of a third party foreign to the contract, or to a case of force majeure.
The order of services by the customer to the concierge does not imply that the service is performed directly by the latter.
Despite all the care taken by the concierge, if it only acts as an agent in the relations between the client and the service providers and suppliers, the concierge assumes no liability for the execution of the contract of sale or service. The concierge service cannot be held responsible for damages or losses of any kind whatsoever, which would be caused by the providers and suppliers including delays in delivery/ realization or non-compliance of a service. Delays in completion do not entail cancellation or modification of the order.
- Obligations and responsibilities of the owner
The owner is obliged to:
- Deliver the dwelling in good condition for use and repair, as well as equipment in good working order.
- D’assurer au locataire une jouissance paisible et la garantie des vices ou défauts de nature à y faire obstacle.
- De maintenir les locaux en état de servir à l’usage prévu par le contrat en effectuant les réparations autres que locatives.
- Déclare être le propriétaire du logement et en avoir la libre disposition et pleine jouissance durant la période du séjour défini dans le présent contrat.
- Obligations and responsibilities of the tenant
The rentals are made under the following charges and conditions that the tenant is obliged to fulfill:
▪ The tenant must be of legal age when concluding the contract, and will be responsible for the
Occupants on his behalf.
▪ When taking possession of the rental, if the tenant shows up with a number of people different from that agreed when signing this contract, the owner or his agent reserves the right to refuse entry to the premises and to cancel the contract without refunding the deposit. The cancellation of the contract may also occur if the tenant does not respect the conditions of commitment during his stay and other people come to stay in the rental without the authorization of the owners or the concierge.
▪ Any excessive consumption of water or electricity will be re-invoiced to the customer
▪ Parties and events are not permitted. In the event of non-compliance with this rule (if a neighbor notices a party or noise pollution by videos or photos or if the police are forced to come), the concierge will be forced to make you leave the premises immediately and the deposit will not be returned to you.
NB: it is not forbidden to receive guests occasionally, within the limit of half the capacity of the accommodation.
▪ The tenant must avoid any noise likely to disturb the neighbors, in particular those emitted by radio, television and other devices.
▪ The tenant will enjoy the rental in a peaceful manner and will make good use of it, in accordance with the purpose of the premises.
▪ Occupy the premises only in a bourgeois manner, the exercise of any profession being prohibited, the tenant recognizing that the premises covered by this contract are rented to him only as a temporary residence and for pleasure;
▪ The tenant may not, under any circumstances, claim any right to remain in the premises after the expiry of the period initially provided for in the contract.
▪ The tenant shall maintain the rented accommodation and return it in a good state of cleanliness and rental repairs at the end of the contract. If items listed in the inventory are broken or damaged, the concierge service may claim their replacement value.
▪ The tenant may not exercise any recourse against the concierge service in the event of theft or damage to the rented premises..
8. ORGANIZATION OF STAYS
A - The security deposit
For all accommodation reservations, a "security deposit" or "deposit" will be required upon taking possession of the rented premises, intended to cover damage and/or deterioration caused by the tenant to the accommodation, furniture, household linen, and objects furnishing the accommodation, as well as loss or damage that could be caused to objects, furniture or other objects furnishing the accommodation, including loss of keys or objects.
This security deposit is paid in the form of a bank imprint. The deposit request is not debited and does not impact the travelers' credit card limit.
Access to the accommodation will not be authorized if the deposit is not secured.
If no damage is found (subject to a compliant inventory and inventory and will depend on the cleanliness of the accommodation), the CB imprint is automatically canceled.
Otherwise, all or part of the deposit will be cashed, depending on the amount of damage caused by the tenant.
If the amount of the losses exceeds the amount of the security deposit, the tenant agrees to pay the damage after the exit inventory. The owner agrees to provide proof of the amount necessary to restore the accommodation.
B – Arrivals and departures
Arrivals of holidaymakers are set between 4pm and 6pm and departures between 8am and 10am.
Outside of these slots, key boxes will be made available to tenants to allow access to the accommodation.
For organizational reasons, holidaymakers must specify their arrival time to the concierge 24 hours in advance.
Please note that any early arrival of holidaymakers before the indicated time will be billed 50 euros to the tenant.
C - Inventory and inventory
An inventory and inventory of the furniture and various equipment will be made available to the tenant when entering the accommodation. The tenant will have 24 hours to check and report any anomalies noted to the concierge. After this period, the rented goods will be considered free of damage when the tenant enters.
D – Maintenance of the accommodation and return of the accommodation
The accommodation is cleaned between each rental by the concierge. However, daily cleaning will be required of each tenant.
When leaving the accommodation, the following instructions must be respected by the tenants:
- Dishes cleaned and put away - Dishwasher emptied
- Trash cans emptied and placed in the containers provided for this purpose
- Barbecues must be returned clean and usable for the next vacationers
- All doors and windows must be closed.
- The keys to the accommodation must be returned to a member of staff at the “La Bretonne” concierge service or placed in the “KEYBOX” box provided for this purpose.
In the event of non-compliance with these instructions, a supplement may be charged and deducted from the deposit.
E - Animals
It is possible that animals may not be allowed in the rentals. This information will be systematically specified in the rental contract.
Failure to comply with this condition would result in the cancellation of the stay without compensation.
F - Interruption of the stay
In the event of early interruption of the stay by the tenant, and if the liability of the owner or his agent is not called into question, no refund will be made, except for the security deposit under the conditions indicated in paragraph A.
- Cases of force majeure
Neither party shall be liable for any failure to perform or delay resulting from force majeure in the event that the party concerned could not have prevented or avoided such failure.
For the purposes of this contract, a force majeure event shall be understood as an unforeseeable event beyond the reasonable control of the parties to the contract, including but not limited to fires, natural disasters or any event recognized by law or by any decision promulgated by any authority of the French Government, civil or military, being a force majeure event.
Strikes, fires, floods, EDF-GDF supply disruptions, the consequences of storms, etc. are considered cases of force majeure.
The non-renewal by government authorities of a residence, occupation, residence or work permit is also considered a case of force majeure.
9. CONFIDENTIALITY
La Conciergerie La Bretonne s’engage à ne divulguer en aucun cas ni à aucun tiers, toute information recueillie au cours de ses interventions auprès de ses Clients, sauf autorisation écrite de ces derniers.
Cette clause devient caduque dans les cas où la loi obligerait la conciergerie La Bretonne à divulguer ces informations. Le Client et La Conciergerie « La Bretonne » concluent le contrat en tant que personnes indépendantes, tant juridiquement que financièrement, sans entité commune.
10. – INTELLECTUAL PROPERTY
All texts, comments, works, illustrations and images reproduced on the website of the conciergerie “La Bretonne” are reserved under copyright and intellectual property law and for the entire world. As such and in accordance with the provisions of the intellectual property code, only use for private use is authorized, subject to different or even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the Conciergerie La Bretonne website is strictly prohibited without prior agreement.
The owner authorizes the conciergerie from now on to take any photos that it deems useful for the exercise of its activity.
11. – PROTECTION OF PERSONAL DATA
Les données collectées sont destinées uniquement à l'usage de la Conciergerie « La Bretonne ». Elles sont nécessaires au traitement et à la gestion des commandes passées par le client ainsi qu’aux relations commerciales entre la Conciergerie La Bretonne et le client. Elles permettent également à la Conciergerie « La Bretonne » de fournir au client des services personnalisés et d’améliorer la pertinence des informations qui lui sont proposées.
La conciergerie La Bretonne est responsable du traitement des données des clients (propriétaires et voyageurs).
Conformément à la loi du 6 janvier 1978, le client et le propriétaire disposent d'un droit d'accès, de rectification, de modification et de suppression des données le concernant ainsi que du droit de s’opposer au traitement pour motif légitime et peuvent exercer leurs droits soit par mail : conciergerie@la-bretonne ou soit par courrier : Conciergerie « La Bretonne » – 8 Clos de la Chapelle - 29870 LANDEDA.
12. – COMPLAINTS AND SETTLEMENT OF DISPUTES
Under Article L. 612-1 of the Consumer Code "Any consumer has the right to have recourse free of charge to a consumer mediator with a view to the amicable resolution of the dispute between them and a professional." Disputes falling within the scope of Article L. 612-1 of the Consumer Code are disputes defined in Article L. 611-1 of the Consumer Code, namely disputes of a contractual nature, relating to the execution of a contract of sale or provision of services, between a consumer and a professional. The text covers national disputes and cross-border disputes.

Thus, in the event of a dispute, the customer agrees to notify the Conciergerie La Bretonne by Registered Letter with Acknowledgment of Receipt so that an amicable solution is preferred before initiating proceedings before the competent legal authorities. 13. – APPLICABLE LAW AND LANGUAGE
By express agreement between the parties, these conditions are governed by and subject to French law. They are written in French. In the event that they are translated into one or more languages, only the French text will be authentic in the event of a dispute. In the event of reproduction of these conditions on other media, only the text available online at the address – https://la-bretonne.fr and, where applicable, on the general conditions appearing on the service proposal written and signed by the client will be authentic..
